Terms of Service
mamoru is an online platform that connects students to sustainable brands and shops. The services provided by mamoru’s website and mobile app (collectively referred to as the "Site") are administered using a platform provided by Gochiso Inc. ("Gochiso"). The Site's services are provided under the following Terms of Service Agreement ("Agreement").
1.0 Application of this Agreement
This Agreement is a legal agreement between Gochiso and users ("Users") that applies to the use and management of all services of the Site. By using any of the services of the Site, Users indicate that they have read and agreed to all sections of this Agreement and the Privacy Policy.
2.0 Terminology

A “User” is anyone who uses the Site.

A "Member" is a registered User of the Site who has given consent to this Agreement and to the Privacy Policy of the Site.

An “Applicant” is a person who wishes to become a Member of this Site in order to use its services.

A “Shop” is a registered business on this Site that sells goods and services.

An “Offer” is a benefit provided by a Shop for a Member on the Site.
3.0 Membership and Registration
Applicants who have completed registration and given consent to this Agreement and the Privacy Policy will receive membership. Applicants may not register as a representative of someone else. Also, individuals under 13 years of age cannot register to mamoru. Those who have had their membership suspended or revoked previously for violating this Agreement, those who have falsified their registration information, or those who are deemed as unfit for the Site may be refused membership.
4.0 Username and Password
Members are responsible for the management of their username and password. Gochiso is not responsible for damages resulting from theft or unauthorized use.
5.0 Managing Account Information
Members are responsible for the management of their account information; for example, they are responsible for keeping their information up-to-date. Gochiso is not responsible for damages resulting from inaccurate or out-of-date information. Also, Member shall bear all responsibilities in the event that such information has caused any damages to Gochiso or a third party.
6.0 Canceling Membership
Members may apply to cancel membership by contacting mamoru (contact@mamoru.earth). Once the cancellation procedures are completed, the membership is considered canceled. Information connected to previous behavior linked to your account may remain on the Site.
7.0 Membership Expiration
Your membership automatically expires after your expected graduation month and year. You may still be able to log in to see your activity, however, you will not be able to use Offers on the Site. (This does not apply to Shop accounts.)
8.0 Gochiso’s Liability Limitations

Gochiso connects Users and Shops and is in no way liable for conflicts among these parties.

Gochiso is in no way liable for damage to equipment (such as telecommunication lines and computers) resulting from system suspension, delay, or stoppage; data loss; damages resulting from unauthorized access to data; or other damages resulting from the use of any of the services of the Site. This shall not apply in the case of malicious intent or gross negligence on the part of Gochiso.

Gochiso provides information as appropriate and also advice to Users, but we are in no way liable for the information or advice in question.

Gochiso is in no way liable for any damages resulting from a User violating this Agreement.

Gochiso is in no way liable for the contents provided by this Site or by any of the services of the Site. However, in the case of an issue between Users and Shops, Gochiso will appropriately handle the issue in accordance with the terms of this Agreement.

Gochiso is in no way liable for any damages caused by a User's inability to use any of the services of the Site.

Gochiso in no way guarantees that Members will purchase products or services via the services of the Site, that the products or services will meet the expectations of Members, or that Members will find the products or services useful.

Gochiso is in no way liable for any damages resulting from product or service delays, inaccurate product or service information, or inaccurate information provided by the Shops.

Gochiso is in no way liable for the inability of Shops to provide Offers.
9.0 Prohibited Acts

Violating the law, this Agreement, warnings from Gochiso about use of the Site, or any other agreements.

Interfering with the functionality of the Site and its services.

Providing false or inaccurate information.

Actions that harm Gochiso or a third party, and actions that harm the rights, property, or reputation of Gochiso or a third party.

Actions that negatively affect the physical and mental well-being of others or threaten public order and standards of decency.

Using or distributing malicious computer files, such as viruses, or e-mails.
-
Using another user’s account without their permission.
-
Leasing, giving, or sharing a username and password to/with a third party.
-
Reproduction, transmission, or distribution of all or part of any provided information to a third party without the permission of Gochiso.

Harassing, abusing, or harming other users of mamoru services.

Using the Site or services for any unlawful intentions.
-
Other acts that Gochiso deems inappropriate.
10.0 Handling of User Information
Personal information distributed to any of the services of the Site or acquired from Users is managed by Gochiso according to Gochiso’s Privacy Policy, and Users of the Site have agreed to the terms of the Privacy Policy. Gochiso uses personal information for the purpose of improving the quality of service for its Users.
11.0 Cancellation Policy

A refund is not possible after an order has been placed. In the case that the Shop cannot fulfill the order, a full refund will be issued to the Member’s respective credit card.

The Shop and Gochiso reserve the right to cancel an order at any time. Gochiso is in no way liable for any losses as a result of the cancellation.
12.0 Proper User Conduct
Users are solely responsible for the information they post, upload, link to or otherwise make available within mamoru services. By accepting the terms of services, you agree that Gochiso plays a passive role as the conduit for the information published. However, Gochiso has the right to remove any user information and content posted in its platforms if deemed appropriate. By using the Site’s services you agree to the below.

Not submit any contents held under copyright acts or owned by a third party. proprietary rights unless you are the owner of such rights or have evidence of permission from the owner.

Be solely responsible for your personal account along with the activities that occur while you are signed in to or while you are using your account.

Not post information that is offensive, inaccurate, and ill-intended.
Any information, opinion, statement made public by the users through mamoru but not directly from the company are the responsibilities of their respective authors and should not always necessarily be trusted. Gochiso cannot and does not guarantee the utmost accuracy of any information on its platforms and neither does it endorse/reject or take responsibility for the reliability of information posted by parties other than Gochiso itself nor liability for anyone’s reliance on information transmitted through our services.
13.0 Modification or Removal of Content
Gochiso reserves the right to modify and/or remove any content, such as content related to Shop accounts, on the Site when deemed appropriate.
14.0 Suspension of Membership
Gochiso may suspend or revoke membership, suspend use of any of the services of the Site, or change the username/password for specific Members, without prior notice, for any of the following reasons. Gochiso shall in no way be responsible for any resulting damages.

Actions that violate the law or this Agreement.

Inappropriate or unauthorized use of any of the services of the Site.

Issues with security and protection, including multiple incorrect password attempts.

Use of another Member’s username and password.
-
Publishing or distributing another Member’s content without prior permission.

For any other reason deemed appropriate by Gochiso
15.0 Suspension, Alteration, or Abolishment of the Service
Gochiso may suspend, alter, or abolish part or the entirety of any of the services of the Site at our discretion, and we are in no way liable for any resulting damages, such as in the following cases.

When we judge that it is necessary to suspend any of the services of the Site due to system maintenance, system failure, natural disaster, or other technical or operational reasons.

When we renew or change the design of a service.
-
When we judge that it is necessary to stop or interrupt any of the services of the Site.
16.0 Changes to these Terms
Gochiso may revise or supplement the terms of this Agreement as it sees fit without prior notice. Revisions or supplements to this Agreement or to any of the services of the Site will be considered active when their content is posted to the Site. By continuing to access or use the Site, Users agree to the revised or supplemented terms.
17.0 Controlling Law and Jurisdiction
The laws of Japan govern this Agreement, the Privacy Policy, and any other separate regulations. Also, any controversy or claim resulting out of or relating to the services of the Site shall be settled in the Osaka District Court in the first instance, without regard to the User’s home state or country of residence.
